TRACT 2: From Hwy. Junction 14 & 39 Albion, NE., 3 miles south on Hwy. 14 to road 290th Street, than 2 miles west to 240 Avenue to the North East corner of property.

TAXES: The sellers will pay for Property Taxes for 2008 and all prior years. 2009 taxes will be the Buyers responsibility. Tract 1: taxes $3202.78 Tract 2: taxes $3831.88

LEGAL:
Tract 1: The Southeast One Quarter (SE ¼) of section fourteen (S14) Township twenty north (T-20-N) Range six west (R-6-W) of the 6th P.M. Boone County NE. Containing 139 acres more or less.
Tract 2: The northwest One Quarter (NW1/4) of Section nine (S-9) Township Nineteen north (T-19-N) Range six west (R-6-W) of the 6th P.M. Boone County, NE. Containing 160 acres more or less.

CONDITIONS OF THE PROPERTY: This property is being sold in “AS IS, WHERE IS” condition. No Warranties, either expressed or implied will be offered by the seller’s or the seller’s agents. Your complete inspection of the property by you and your experts prior to the auction is encouraged. This sale is subject to all easements, covenants, leases and restrictions of record. All information is provided by sellers and is believed to be correct; however, buyer’s and/or buyer’s agent/broker shall bear the responsibility to confirm all information prior to auction. No absentee or telephone bids will be accepted at the auction without prior approval of the auctioneer.
 

Survey: Any survey needed will be the buyers costs.

Financing: Please make prior arrangements for any/all financing prior to the auction day. This property is not subject to buyer(s) obtaining financing.
Title Insurance: The Seller(s) will provide at closing a owners policy of the insurance in the amount of the purchase price. The cost of such title insurance will be shared equally between Buyer(s) and Sellers(s).
Marketable Title: Marketable title for the property will be given to the new Buyer(s) on the date of closing.
Auction Day Terms: Ten percent (10%) earnest money payment is required day of the auction. The earnest payment may be paid in the form of a check. At the conclusion of the auction, the highest bidders will enter in to a real estate contract and deposit ten percent of the sale price with Wegener Realty and Auction Trust Account. The purchase contract will establish terms and conditions of the sale.
Auction Format: All bidding is open to the public. Conduct of the auction and increments of bidding are at the sole direction and discretion of the Auctioneer. Announcements made from the podium the day of the auction supersede all printed material. All bidders will be required to register for a bidding number prior to the commencement of the auction.

Possession: Possession will be granted March 1, 2010
Closing: The projected closing date is on or about October 23, 2009
